Distance Sales Agreement

This Distance Sales Agreement is made electronically between the buyer and NutriSmart Tekstil Sanayi ve Ticaret Ltd. Şti., headquartered in Nilüfer, Bursa, Turkey, through www.nutrismart.com.tr, in accordance with the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts.

Subject of the Agreement

This agreement covers the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts, related to the purchase and delivery of the product(s) whose features and sales price are specified below and ordered electronically by the Buyer from NutriSmart’s website.

Product Name(s), Quantity, Total Amount, Payment Type, Delivery Address and Details are specified in the order confirmation email and invoice.

General Provisions

  • The Buyer acknowledges that they have read and understood all information regarding the basic features, sales price, payment method, delivery, and right of withdrawal of the product subject to sale, and gave the necessary confirmation electronically.

  • The product(s) will be delivered to the Buyer or the designated person at the delivery address within the time promised on the website, not exceeding 30 days.

  • If the Seller fails to fulfill its obligations due to force majeure or extraordinary circumstances, the Seller shall inform the Buyer within 3 days and refund the total amount within 14 days, if applicable.

  • The shipping cost belongs to the Buyer unless otherwise stated on the website.

Right of Withdrawal

  • The Buyer has the right to withdraw from this agreement within 14 days from the date of delivery without giving any reason and without any penalty.

  • To exercise the right of withdrawal, the Buyer must notify NutriSmart in writing via email or registered mail.

  • The product must be returned unused, undamaged, and complete in its original packaging.

  • Return shipping costs are the responsibility of the Buyer unless the product is defective or incorrect.

Products Not Eligible for Return

  • Cut-to-order or customized fabrics

  • Products prepared in line with the Buyer’s personal requests

  • Products whose protective packaging has been opened and are unsuitable for return for health and hygiene reasons

Dispute Resolution

In case of any disputes arising from this agreement, complaints can be submitted to the Consumer Arbitration Committees and Consumer Courts located in the Buyer’s or Seller’s district within the monetary limits defined by the Ministry of Trade.

Enforcement

This agreement is deemed to be accepted by the Buyer electronically at the time the order is placed. NutriSmart reserves the right to update this agreement in line with legal requirements.
